Good morning
It is with great pleasure that we are sending you the latest edition of the newsletter, which we hope you find a useful source of enjoyable information. We have also included the May itinerary for the Vision Support Cheshire mobile information unit.
Many people ask about Gift Aid when donating to charities, so we have included a form on the back page of the newsletter.
This month a number of new recipients have joined our circulation. Welcome.

Hi, I am sorry, when I went to open up a xoom account I accidentally put the wrong ending on my email which ended up probably sending you a request to verify and login. I am sorry about that and hope I didn´t cause any problem. I wrote and email to xoom and called them up letting them know what happened.
I and my family minister here in brasil as missionaries and was trying to do some necessary transactions on-line.

This time I asked if there was a discount for a 3rd ticket if I want to bring two chicks...

Sorry about the delay in getting back to you but yesterday was Super Tuesday for Irish Banks so I was up the walls in work.
I have some bad news I am afraid though. My mother has organised a family gig over the weekend which I am going to have to attend.
She was sick recently and wants everyone in the family to be there.
Apologies for letting all the lads down, it is not meant but the mother is pulling the sympathy strings.

A NATIONAL radio station has been forced to issue a second personal apology to Health Minister Mary Harney broadcasting damaging claims about her private life.
In a fresh apology yesterday, Newstalk radio station said allegations made on ‘The Tom Dunne Show’ by veteran journalist Nell McCafferty were “untrue and were known to be without truth when they were broadcast”.
Spokespeople for Ms Harney last night declined to comment on the damning personal remarks made by Ms McCafferty.
But, Newstalk issued a second apology yesterday morning following the controversial broadcast on Thursday.
“The interview should never have been broadcast and the fact that these allegations were made represents an abject failure on the part of Newstalk to meet basic standards of common decency,” the statement said.
“Newstalk apologises without reservation to Mary Harney. Newstalk deeply regrets the fact that these allegations were made and accepts that these untruthful statements were deeply hurtful to Mary Harney and her family.”
Each and every one of the allegations made on the show were “untrue and were known to be without truth when they were broadcast”, the statement added.
The minister’s absence from the country has been a source of intense controversy amid growing calls for her to return to deal with the X-ray scandal in Tallaght hospital.
Sources close to the minister are said to be outraged at the remarks by Ms McCafferty, saying they were both false in nature and derogatory.
Meanwhile, the head of the Oireachtas health committee has questioned the length of Health Minister Mary Harney’s trip New Zealand for St Patrick’s Day.
Fianna Fail Kildare South TD Sean O'Fearghail said it was surprising she made a 15 day trip.
“I’m surprised in the current climate that anyone would be gone for that length of time. I would have thought a shorter, more intensive trip on behalf of all ministers would be more appropriate,” he said.
However, Mr O'Fearghail firmly backed Ms Harney’s handling of the controversy over the 58,000 X-rays in Tallaght Hospital that were not reviewed by a consultant radiologist and the 3,000 letters from GPs left unopened.. He placed the responsibility for the crisis on the hospital management and staff.
“My own view is that culpability must lie somewhere, it lies ultimately within the hospital and any study of the circumstances will have to identify those who made the decisions which resulted in the x-rays not being reviewed and the letters not being opened,” he said.
Ms Harney is on a 15 day junket in New Zealand for St Patrick’s Day festivities and business meetings with her husband Brian Geoghegan, the former chairman of FAS, and three advisors.
The minister left for the action-packed trip Down Under on Saturday March 6th and will not return until Sunday March 21st- as the latest crisis to hit the health service prompts renewed calls for her resignation.
The minister is dealing with the misdiagnosis crisis remotely from New Zealand- but her absence in the Dail has drawn sharp criticisms from Opposition parties who claimed she had “ignored” the problem of unchecked X-rays when it was first raised in December

I am very concerned by the contents of your letter and in particular that you have received a number of calls from constituents being advised by our advisers at the Chester office 'we cannot see you for six weeks, get in touch with your MP'. This horrifies me and suggests that that those people who come to our organisations for help are being used as pawns to serve other people's agendas.
In Andrew's last letter he recommended a review of the changes and the impact thereof as well as suggesting a meeting between yourselves and representatives of our organisation.
I can confirm that it has always been scheduled to review the changes and that this review is set for April. I suggest that a meeting between ourselves has a greater urgency than that and would welcome such as soon as is mutually convenient. I have copied Michael Brennan (Director of Bureaux Services) and Jason Bishop (Community Services Manager) and by copy am asking them to liaise with Andrew and yourself to arrange a suitable time to meet.
I look forward to meeting as soon as possible and ensuring that all parties are appraised of the complete situation here and comfortable that the people we help come first as far as funding permits.

Sadly there has been some unacceptable behaviour by a few during this episode and that has been the subject of formal procedures – there are still some potential issues outstanding. You will appreciate that it is not appropriate for me to discuss these in this letter.

hello Michael...Noelene, greetings from very sunny but freezing Scotland...I don't mind because I have not seen the sun for over a month. not back at the coal face but rather the wood face...six door frames to strip plus skirting boards and rail bannisters etc etc...! ! !..hopefully will be completely by next christmas...one never knows .

Just to let you both know that MH and SO have written to the Chair of Citizens Advice John Galdwin and the CEO David Harker, raising concerns about gateway (SO) and gateway and volunteer representation on TB (MH). I have updated both on the changes implemented by management and trustees, the range of help and support from Citizens Advice and advised any response to be limited and supportive to CWCAB as the issues raised have been well aired and the progress continues to be reviewed by the TB and management team.
As mentioned Michael I do think having some PDF style document explaining the services CWCAB offers and how to access them will be useful particularly to circulate to councillors and CW and Chester Council officers. Interestingly I saw a pocket style promotional document prepared by Wolverhampton CAB on Monday - let me know if you are interested in getting a copy.

Val just asked me to have a quick look and this and get back to you directly if I had any comments.
Obviously I'm not fully aware of the whole background, and I understand you do get legal advice from Abbey Legal, but I just wanted to raise a couple of questions in case you haven't covered it with them.
Were the statutory retirement procedures followed before these 2 people reached 65? If not then you should still be using the outline of the procedures to retire them now i.e. giving them at least 6 months notice of retirement, allowing them to request to stay on, having a meeting and then retiring them. I couldn't tell from your email whether you were intending to do this, but was a bit concerned that if you were going to persuade people to resign rather than retire you could risk unfair dismissal claims. If you call it retirement but you haven't actually followed the statutory retirement procedures the employees could also claim compensation of up to 8 weeks pay.
I don't have an issue with you retiring these 2 employees (although as you have said, it is good practice to allow people to stay working after 65 if they want), but i just wanted to check you were aware of the procedure that should be followed and any risks of not following it if you choose to do so.
More than happy to have a chat with you about this if you feel it would be helpful. I apologise in advance if you have already got advice from Abbey about this.

I was trying to keep any specifics out of this but can understand that the way I have presented this has probably given the wrong impression.
The current state of play is that employees can request to continue working beyond 65 and it is at the employers discretion whether they agree. Historically the approach to this has varied through the bureaux.
As Les points out there is much discussion and I believe proposals to alter this (I suspect the pending election will impact on this as well).
As an organisation I believe (and I know the management team do) that we should be encouraging people to work on as long as they are capable and happy to.
We have a very difficult situation currently with one member of staff who has given many many years of loyal service to the bureau. Despite a considerable amount of effort, resource etc by the management team this member of staff is a capability scenario and a risk to the organisation. The member of staff would never resign and we currently have no choice but to go down a capability route which would be very sad for all concerned. We have one other member of staff who is over 65 who Michael is confident would accept resigning.
It is therefore our view that the kindest option currently is to retire the person concerned which of course can only be done if this is accross the piece ie both.
There is no need to change any contracts as the current law leaves acceptance of continued working at the discretion of the employer so this does not become a standard irrevocable policy.
Moving forward this is an area that we need to be guided by changes in the law but in the interim we are following the letter of the law.
I should emphasise this will be a painful and emotive decision for the person concerned and the management team carrying it out but it is the view of the management team, Richard and I that this is the kindest route. I should also emphasise that Richard and I are aware of the history of this person as they are from the old Vale Royal bureau.
I apologise for not providing a fuller explanation last night - it was a long day!
I did reply to Cathy last night who is now happy with this but can I start again and ask anyone who still objects just to let me know for close Monday - if anyone does object then obviously we will not go forward.

Michael and the management team have proposed imposing complusary retirement for paid staff over 65 - this currently only affects two members of staff and suits business need. The management team feel that one of the members of staff would be more than happy with this and in the case of the other it is very much in that persons best interests.
Richard and I are fully supportive but out of courtesy wanted to ensure the board had an opportunity to comment before the management team implemented with these members of staff.
As there is some urgency could I ask that should anyone feel strongly against they let me know by say close Monday so the decision can be taken Tuesday,

Val just asked me to have a quick look and this and get back to you directly if I had any comments.
Obviously I'm not fully aware of the whole background, and I understand you do get legal advice from Abbey Legal, but I just wanted to raise a couple of questions in case you haven't covered it with them.
Were the statutory retirement procedures followed before these 2 people reached 65? If not then you should still be using the outline of the procedures to retire them now i.e. giving them at least 6 months notice of retirement, allowing them to request to stay on, having a meeting and then retiring them. I couldn't tell from your email whether you were intending to do this, but was a bit concerned that if you were going to persuade people to resign rather than retire you could risk unfair dismissal claims. If you call it retirement but you haven't actually followed the statutory retirement procedures the employees could also claim compensation of up to 8 weeks pay.
I don't have an issue with you retiring these 2 employees (although as you have said, it is good practice to allow people to stay working after 65 if they want), but i just wanted to check you were aware of the procedure that should be followed and any risks of not following it if you choose to do so.
More than happy to have a chat with you about this if you feel it would be helpful. I apologise in advance if you have already got advice from Abbey about this.

I was trying to keep any specifics out of this but can understand that the way I have presented this has probably given the wrong impression.
The current state of play is that employees can request to continue working beyond 65 and it is at the employers discretion whether they agree. Historically the approach to this has varied through the bureaux.
As Les points out there is much discussion and I believe proposals to alter this (I suspect the pending election will impact on this as well).
As an organisation I believe (and I know the management team do) that we should be encouraging people to work on as long as they are capable and happy to.
We have a very difficult situation currently with one member of staff who has given many many years of loyal service to the bureau. Despite a considerable amount of effort, resource etc by the management team this member of staff is a capability scenario and a risk to the organisation. The member of staff would never resign and we currently have no choice but to go down a capability route which would be very sad for all concerned. We have one other member of staff who is over 65 who Michael is confident would accept resigning.
It is therefore our view that the kindest option currently is to retire the person concerned which of course can only be done if this is accross the piece ie both.
There is no need to change any contracts as the current law leaves acceptance of continued working at the discretion of the employer so this does not become a standard irrevocable policy.
Moving forward this is an area that we need to be guided by changes in the law but in the interim we are following the letter of the law.
I should emphasise this will be a painful and emotive decision for the person concerned and the management team carrying it out but it is the view of the management team, Richard and I that this is the kindest route. I should also emphasise that Richard and I are aware of the history of this person as they are from the old Vale Royal bureau.
I apologise for not providing a fuller explanation last night - it was a long day!
I did reply to Cathy last night who is now happy with this but can I start again and ask anyone who still objects just to let me know for close Monday - if anyone does object then obviously we will not go forward.

Michael and the management team have proposed imposing complusary retirement for paid staff over 65 - this currently only affects two members of staff and suits business need. The management team feel that one of the members of staff would be more than happy with this and in the case of the other it is very much in that persons best interests.
Richard and I are fully supportive but out of courtesy wanted to ensure the board had an opportunity to comment before the management team implemented with these members of staff.
As there is some urgency could I ask that should anyone feel strongly against they let me know by say close Monday so the decision can be taken Tuesday,

LIMITS OF LIABILITY
The applicable limits of liability for your journey on a flight operated by Aer Lingus, are as follows:
1. There are no financial limits in respect of death or bodily injury;
2. In respect of destruction, loss of, or damage or delay to baggage, 1,000 Special Drawing Rights per passenger (approximately EUR 1,230). Warning: If the value of your baggage is greater you should fully insure it before you travel or should bring this to the attention of the airline at check-in, because you can make a special declaration of value and pay the airline’s applicable supplemental fee to benefit from a higher limit of liability;
3. For damage occasioned by delay to your journey, 4,150 Special Drawing Rights per passenger (approximately EUR 5,100).
If your journey also involves carriage by other airlines, you should contact them for information on their limits of liability.
Time limit for action: Any action in court to claim damages must be brought within two years from the date of arrival of the aircraft, or from the date on which the aircraft ought to have arrived. Baggage claims: Written notice to the carrier must be made within 7 days of the receipt of checked baggage in the case of damage, and, in the case of delay, within 21 days from the date on which it was placed at the disposal of the passenger.

Today July 21, 2009 around 10:34 I had a call from Delhi. I returned the call around 10:40 and conditionally accepted a position in HP with a final acceptance in the first week of September 2009. The assignment is a great challenge. Try developing 15,000 acres!
CU has been good but I have learned nothing over the year and half I have been here. In the next 6 months I will have completed all that I have to offer and structure the manner in which the $2M grant will be spent. So, in the first quarter of 2010 I will relocate.
Between now and the first quarter of 2010, I will complete the difficult task of obtaining State permits for the Berkeley Heights property. I may have time to execute the conditions of the permit. Options there after are to build and rent or sell. Unless I hear of any serious interest from any one of you, I will decide on whatevr suits me.
Please plan accordingly and let me know if you need anything done while I am here.

7/14/2009 - Someone Found A Hotel
One of my favorite kinds of messages in one where they don't provide a link to what they are referring to in the message. I think I found the hotel by searching Google. Overpriced, over fancy. How much time are you really going to spend in the hotel room, especially in a place like San Francisco? In fact, I was recently there, and stayed in a very nice Sheraton Hotel in the Fisherman's Warf district, it was great. I replied back to them, recommending this hotel.

Found campton place taj hotel supposed to have been named one of the best places to stay in the world. Rooms start at 140 a night and on hotels.com it's ranked up there with the st Regis and four seasons. Clifton is the other choice at 179 a night, or the Hilton for 99 a night, all by union square.

7/2/2009 - 20 Year Reunion
Dummy in Ohio at it again. I'm not him, and I'm way past any 20 year reunions! Oh, and I love the segway to selling me insurance. That is a great way to greet an old friend!
